The Town of Oulu regular board meeting was called to order by Jonathan Hamilton, chair at 6:46 p.m. at the Town Hall.

Roll call:

Members present: Edward Burhans, Timothy Ciembronowicz, Jonathan Hamilton, Diana Reijo, clerk, and Marjorie Lahti, treasurer.  Absent: None.

Approval of agenda:

Motion by Ciembronowicz, second by Burhans to approve the agenda as printed and posted. Motion carried unanimously by voice vote.

Consent agenda:

Motion by Ciembronowicz, second by Burhans to approve the consent agenda as printed and posted:

  • Approve general fund vouchers 13396-13417 and ACH 503-506
  • Minutes of the September 8, 2021 regular board meeting, September 10, 2021 special board meeting and September 14, 2021 special board meeting

Motion carried unanimously by voice vote.

Treasurer’s Report: General $103,462.60   Tax Account $84,604.48 Local Fiscal Recovery $27,789.50

Plan Commission Report: Fred Strand

Special Use Application:

  • Owner: Peter Hexum
  • 20-acre parcel in the SE¼ NE¼ Section 36; 70745 Range Line Road
  • Allow short term rental of bunkhouse
  • Tax ID parcel number is 37704
  • Parcel is zoned Agriculture 1

Findings:

  • Parcel is located in the NE¼ NE¼ and SE¼ NE¼of section 36
  • Parcel size is 19.725 acres
  • Parcel is zoned Agricultural 1
  • Parcel 37704 was created from former parcels numbered 37156 and 37158
  • The former and current parcels were legally created out of larger parcels after the Town’s Comprehensive plan was adopted.
  • A Special Use Permit was previously issued for a bunkhouse and later a Special Use Permit was issued to change the bunkhouse to a second residence on this parcel.
  • Parcel Future Land Use Class is Agricultural Core which allows the maximum density of 1 building unit complex per 35 acres
  • When the previous special use permit applications were considered, the Plan Commission recommended and the Town Board agreed, that the next time the Comprehensive Plan is revised that the Future Land Use designation for this parcel should be change to Agricultural-Limited Residential which allows for 1 dwelling complex/10 acres (or 2 dwelling complexes for 20 acres).
  • The Town’s Comprehensive Plan does not address short term house rental.
  • The Special Use Permit application to allow short term rental of the second house on this parcel is consistent with the Zoning Classification and does not conflict with the Future Land Use Class for the parcel.
  • The owners will also have to obtain a short term rental permit from the Bayfield County Health Department

Plan Commission Recommendation:

Approve the Special Use Permit application with the following conditions as supported by the Findings.

Conditions:

No change in the permit application proposal is allowed without review by the Town Plan Commission and approval of the Town Board.

The owners also have to obtain a short term rental permit from the Bayfield County Health Department and any other required County permits

The Town may periodically review the Special Use Permit to assure compliance with the permit conditions and the Town’s Comprehensive Plan.

Special Use Permit application:

  • Owners: Mark and Jacqueline Karshbaum
  • 5.054-acre parcel in the NW¼ NW¼ Section 25; 71890 Airport Road
  • Residence in a parcel is zoned Agriculture 1

Findings:

  • Parcel size is 5.054 acres
  • Parcel is zoned Agricultural 1
  • Parcel Future Land Use Class is Agricultural Core which allows for 1 building complex per 35 acres
  • This parcel was legally created after the Town’s Comprehensive Plan was adopted.
  • The next time the Comprehensive Plan is revised that the Future Land Use designation for this parcel should be change to Rural-Moderate Residential which allows for 1 building complex per 5 acres.
  • The Special Use Permit application for a residence on this parcel is consistent with the zoning district and with a future change of the Land Use Classification Rural-Moderate Residential for this parcel.

Plan Commission Recommendation:

Approve the Special Use Permit application with the following conditions as supported by the Findings.

Conditions:

  • No change in the project construction type (new construction, mobile house, manufactured house, recreational vehicle) is allowed without review by the Town Plan Commission and approval of the Town Board.
  • The Town may periodically review the Special Use Permit to assure compliance with the permit conditions and the Town’s Comprehensive Plan.
  • The next time the Comprehensive Plan is revised the Future Land Use Classification for this parcel should be changed to Rural-Moderate Residential.

Airport Road Update:

Crack fill on Airport Road was scheduled to be completed by September 30, 2021. Solon Springs Concrete completed it on October 4, 2021. We are still awaiting a remediation plan from Weyandt Engineering, Solon Springs Concrete, and Northwoods Paving to provide a preliminary estimate of scope and cost with final plan being adapted/adjusted based on road conditions in the spring. A special meeting will be scheduled once the plan is received.

New Business:

Peter Hexum’s Special Use Request:

Motion by Ciembronowicz, second by Burhans to approve Peter Hexum’s special use request to change use of his bunkhouse from long-term rental to short-term rental as based on the Plan Commission’s recommendation with the following conditions as supported by the Findings:

  • No change in the permit application proposal is allowed without review by the Town Plan Commission and approval of the Town Board.
  • The owners also have to obtain a short term rental permit from the Bayfield County Health Department and any other required County permits
  • The Town may periodically review the Special Use Permit to assure compliance with the permit conditions and the Town’s Comprehensive Plan.

Motion carried unanimously by voice vote.

Mark/Jacqueline Karshbaum’s Special Use Request:

Motion by Ciembronowicz, second by Burhans to approve Mark and Jacqueline Karshbaum’s special use request to construct a residence in an Agricultural-1 zoning district as based on the Plan Commission’s recommendation with the following conditions as supported by the Findings:

  • No change in the project construction type (new construction, mobile house, manufactured house, recreational vehicle) is allowed without review by the Town Plan Commission and approval of the Town Board.
  • The Town may periodically review the Special Use Permit to assure compliance with the permit conditions and the Town’s Comprehensive Plan.
  • The next time the Comprehensive Plan is revised the Future Land Use Classification for this parcel should be changed to Rural-Moderate Residential.

Motion carried unanimously by voice vote.

Snowplowing Appeal:

A discussion was held regarding a snowplowing appeal received from Marjorie Falter to snowplow private parking lots.  Supervisors Burhans and Ciembronowicz met individually with the Falters’. Motion by Ciembronowicz, second by Hamilton to not plow private parking lots as supported by the legal documentation received from Wisconsin Towns Association, Spears and Carlson, and Attorney General that is on file from December 2013 stating it is illegal to plow private parking lots; add no snowplowing of private parking lots to the snowplowing notice; and post it on the website.  Motion carried unanimously by voice vote.

Purchase of Snowplow for Pickup:

Two quotes were obtained:  Bear Port Town Tire – $7900.86, Rob’s Snowplow Sales & Service – $7715.

Motion by Ciembronowicz, second by Burhans to accept the quote from Rob’s Snowplow Sales & Service for $7715.  Motion carried unanimously by voice vote.

Pickup/Snapper mower bids:

Advertising for bids for the pickup and Snapper mower will be included with the tax notices.

Draft policies for handbook:

Tabled.

Letter for park donations:

The board approved a letter generated by Supervisor Ciembronowicz soliciting donations for Oulu Pioneer Memorial Park.

Norvado estimate on open wire access:

Supervisor Ciembronowicz provided us with an estimate from Norvado on open wire access.  Additional information needs to be secured.

Salt shed report:

An inspection report was received from WI DOT – Bureau of Highway Maintenance regarding our salt shed.  Minor repairs are needed to the roof, walls, and door.

Cemetery/Park/Road Maintenance:

Preparing for the upcoming winter season.

  • Budget committee meeting scheduled for November 3, 2021, at the town hall, beginning at 6:30 p.m.
  • Regular board meeting scheduled for November 10, 2021, at the town hall, beginning at 6:45 p.m. Bills will be reviewed at 6:30 p.m.
